1. Incomplete or Inaccurate Site Surveys
The City of Toronto requires a professional topographic survey for almost every infill project. If your survey is outdated or missing key information—like the exact location of a neighbour’s tree or the precise elevation of the laneway—the City examiner will flag it immediately.
How to Avoid It: Don't try to save money on a "basic" survey. Invest in a comprehensive topographic survey that includes all trees, neighbouring structures, and utility poles within the required radius.
2. Zoning Non-Compliance (The "Minor" Variance Trap)
Toronto has specific "as-of-right" rules for laneway and garden suites. If your design exceeds the allowable height, footprint, or setbacks by even a few centimetres, you will be forced to go to the Committee of Adjustment for a minor variance. This can add 3 to 5 months to your timeline.

3. Tree Protection and Urban Forestry Issues

How to Avoid It: Hire an arborist early. If your project requires a tree removal permit or a "Permit to Injure," submit those applications before or concurrently with your building permit to ensure Forestry doesn't become your biggest bottleneck.
4. Utility Coordination (Toronto Hydro & Water)
Your permit might be approved by the Building Department, but you can't start work until the utilities are coordinated. If your new suite requires a service upgrade or a new connection that interferes with City infrastructure, you may face lengthy "Letter of Understanding" (LOU) processes.
How to Avoid It: Start the conversation with Toronto Hydro and Toronto Water during the design phase. Knowing their requirements for meter placement and service trenching early prevents last-minute design changes that can void your permit.
5. Poor Communication with the Examiner
Once your permit is assigned to an examiner, they may issue "Notices of Non-Compliance." If your designer or builder takes weeks to respond to these technical questions, your application sits idle.
